Terms and Conditions of Use

Exclusive Genetics (EG) is acting as an agent for sellers/consigners.

Bidding – Some items will be sold to highest bidder and some items will be sold to first bidder that bids reserve price. All prospective buyers are urged to take notice of and thoroughly read the sales conditions for each item being sold.

Terms – Terms of the sale are cash due within five (5) business days of final bid. The guaranteed funds, should be made payable to Exclusive Genetics (the agent) and sent to PO Box 200, Orchard, TX 77464. Payment may also be made by bank wire (contact EG Office) or by credit card at www.exclusivegenetics.com

Guarantees – All guarantees, if any, shall be such as agreed upon between buyer and seller. EG is only an agent and will not be responsible for any warranties (implied or expressed) or guarantees.

Buy Registration - All buyers must register and receive a buyer’s number. EG reserves the right to refuse to accept and/or reject and/or ignore any bid(s) from any person(s) whomsoever; provided, however such exclusion of or refusal to accept bid(s) shall not be made on basis of race, sex, color, or creed.

Buyer's Premium – A 5% BUYERS PREMIUM WILL BE CHARGED ON ALL PURCHASES. EG will help line up trucking/delivery of purchase and EG will get ABBI papers(if any) transferred for new owner.

Buyer’s risk and post sale care – Once the final bid is made, the item being sold becomes the risk of the buyer. Buyers will have fourteen (14) calendar days to obtain possession of its purchase, and must do so within this time period.

Hold harmless – All sellers/consigners, prospective bidders/buyers agree to save, hold harmless, and indemnify EG, its employees, agents, directors, partners or officers from and against any and all liability, debt, claims, suits, losses, damages, cause of action, judgments, costs and expenses; including attorney’s fees arising of allegedly arising from personal injury or death of any person or animal including but not limited to any claims arising out of injuries of damages caused by the item sold after the items is declared sold (final bid) including but not limited to employees of sellers(s) or buyer(s).

Neither EG, nor any of EG employees make any representations or warranties of any kind, expressed or implied, about the items sold or offered for sale. Including any warranty as to soundness, merchantability, fitness for any particular purpose or breeding qualities. Additionally EG does not guarantee any success of a sale on sales price. All such representations and warranties are hereby expressly disclaimed.

EG does require its consignors to operate with integrity when using EG as its agent. If there is ever a dispute by an EG buyer, EG has the right to demand the consignor refund one hundred percent (100%) of sales price (including EG commission which will be retained by EG) to buyer. EG will do its best to be fair and reasonable on any dispute, but by becoming a consignor, you agree to abide by EG decision.

Governing law – This agreement shall be governed by and interpreted and construed under the laws of Texas and is performable in Fort Bend County, Texas.
